TERMS AND CONDITIONS
When accesing The Yoga Factory Annandale or The Yoga Factory website you are agreeing to comply with the Terms and Conditions below. The term “you” refers to the student of The Yoga Factory (Annandale) the visitor of The Yoga Factory or the viewer of The Yoga Factory website.
Please note that we reserve the right to update these Terms and Conditions at any time. Therefore, please be responsible for checking the Terms and Conditions page on our website for any changes.
School’s Terms and Conditions
Before purhasing any pass option, enrolling into the any course or booking into any workshop, please read our Terms and Conditions thoroughly.
The Yoga Factory reserves the right to cancel or change the time of any class without notice. Please check the timetable on theyogafactory.com.au as well as our social media platforms for any last minute changes.
Teacher substitutions may occur. This might happen without notice and no refund will be provided for the classes with a substituted teacher.
Please arrive at least 5 minutes before class as late entry is discouraged and cannot be guaranteed.
Please check in at reception desk before each class.
The Yoga Factory and our teachers are not in any way responsible for any loss or damage of your personal property.
For classes at The Yoga Factory, bookings can be made online and prior to the class start date. You need to have active payment option available and attached to your mindbody account or make a payment upon booking. No refund will be provided for cancellation from your side. Please consider your purchase and booking choice carefully.
You must notify the teacher if you have any special medical conditions or injuries.
If you are pregnant, become pregnant or are post-natal or post-surgical, you agree that you have physician’s approval to participate.
You also affirm that you alone are responsible to decide whether to practice yoga and participation is at your own risk. You decide to participate in the activities held at The Yoga Factory with full knowledge that there is risk of personal injury, property loss or death.
If you experience any pain or discomfort, you agree to listen to your body, discontinue the activity, and ask for support from the teacher.
You agree to assume full responsibility for any and all damages,
which may incur through participation. You agree that you understand that Yoga is not a substitute for medical attention, examination, diagnosis or treatment.
You must follow all instructions given to you by The Yoga Factory teachers and you acknowledge that any failure to do so will be at your own risk.
By attending The Yoga Factory or booking into a class you automatically agree to the above Terms and Conditions.
Cancellation policy
If not attending, you must cancel your booking at least 12 hours before class start time. You can do so through The Yoga Factory website (www.theyogafactory.com.au) or the MindBody app.
Students on unlimited monthly passes or unlimited direct debit passes who book into a class and fail to attend might be charged a no-show fee.
Students on unlimited passes who book into a class but cancel the booking within 12 hours of the class start time will be charged a $10 late cancel fee.
Students using a Drop In or a 10 Class Pass who book into a class but fail to attend or cancel their class within 12 hours of the class start time, will forfeit their class.
In the case of an emergency cancellation, please contact us via email, text or a phone call.
Class passes
10 Class Passes are only valid for 6 months after first use.
The Yoga Factory does not offer refunds or suspensions on 10 Class Passes for change of mind, injury, illness, change of the living suburb or any other reason. All purchases are final.
The Yoga Factory does not offer suspensions, extensions or refunds on Unlimited Monthly Passes. The purchase you make is final.
You cannot share passes with friends, family members or else. Anyone found to be sharing their pass will be denied entry and have their pass cancelled.
Any non-cancellations or no shows will result in forfeiting that visit. If you do not attend a booked session or cancel within 12 hours of class start time, you will be charged for the class.
You cannot use your passes to attend special events, workshops or courses, unless event terms state otherwise.
Workshops and Special Events
The Yoga Factory does not offer refunds or credits on workshops for change of mind, injury, illness or any other reason. All purchases made by you are final.
Payments need to be made upon booking.
You can transfer your workshop “ticket” into another person’s name if you cannot attend the event yourself. You must notify The Yoga Factory via phone or email as soon as possible.
Please arrive at least 20 minutes before the scheduled start time of the workshop or any other special event.
There is no refunds for no show or late-coming.
Pricing
All prices are quoted in Australian Dollars ($AUD) and all transactions are processed in Australian Dollars ($AUD).
The Yoga Factory reserves the right to amend prices and printing or typing errors.
Prices are subject to change without notice.
Prices may increase from time to time to reflect increases in cost and benefits.
All purchases are final. The Yoga Factory does not offer refunds, transfers or suspensions on services(classes), workshops, beginners courses and other special events for change of mind, injury, illness or any other reason.
You cannot transfer your passes to another person’s name.
The Yoga Factory reserves the right to pass on the cost of any additional bank fees which may incur from disputed or failed transactions regarding a students account.
Direct debit membership
By entering the direct debit membership with The Yoga Factory you will agree to the following terms and conditions:
● Monthly Unlimited Direct Debit Agreement is for a minimum of 6 months.
● You will be charged $185 on the same date every month. For example if you sign-up and pay for the Monthly Unlimited Direct Debit on the 5/01, then you will be charged on the 5th of each month.
● For Monthly Unlimited Direct Debit suspensions, we require at least 7 days notice prior to your next billing date.
● You can suspend your membership for a minimum of 7 days and up to 6 weeks at a time. (If you need a longer suspension, please contact us to discuss your personal situation).
● To suspend your Monthly Unlimited Direct Debit, please contact us in writing via liza@theyogafactory.com.au.
● Please be responsible for making sure sufficient funds are available on your bank account to cover your $185 dollar monthly payment. If a payment is declined for any reason, The Yoga Factory reserves the right to process payment at any time to settle any debt. If an auto payment is declined due to insufficient funds, the transaction will fail which requires additional administration and brings additional bank costs. Unfortunately, payment processor may charge a fee for failed transactions. This fee will attempt to be debited every day for 7 days after the failed payment and you will be unable to book or attend classes until your payment has been settled. When direct debit fails to go through for 7 days, there is going to be a 4$ fee for converting direct debit declines into your account balance.
● The Yoga Factory is not responsible for any additional bank fees that may incur from your bank.
● If you decide to cancel your Monthly Unlimited Direct Debit, we require at least 7 days notice prior to your next billing date. Cancellation notice must be made in writing and sent to us via email to liza@theyogafactory.com.au . You must settle all your account debts before cancellation.
● The Yoga Factory doesn't allow refunds on Monthly Unlimited Direct Debit payments.
IMPORTANT: Your direct debit commitments WILL AUTO RENEW once your contact term is completed. It is YOUR RESPONSIBILITY to cancel your membership at least 2 weeks prior to the end date.
Yoga Teacher Training Policy and Terms and Conditions
Teacher Trainee Code of Conduct
To ensure high standards, it is expected that teacher trainees (trainee) achieve the minimum standard and beyond for teaching yoga. The assessment and regular feedback on the trainee’s progress will be provided on a continuous basis throughout the course. If for any reason a trainee does not meet the required standards, a personal discussion will be conducted to ensure the trainee’s understanding of the requirements, and he/she will be asked to improve in the areas of weakness before the issue of a certificate.
During your studies, it is expected that you act in accordance with Yoga Australia Code of Professional Conduct. It is a pre-requisite to beginning the teacher training program with The Yoga Factory that trainees read and understand the Code. Non-compliance with this Code is reasonable grounds for expulsion.

It is expected that teacher trainers (trainer) act in accordance with Yoga Australia Code of Professional Conduct. It is a pre-requisite to being a trainer that the Code is read and understood. For more information see:

Complaints Policy
It is expected that your teacher trainers act at all times in accordance with Yoga Australia’s Code of Professional Conduct. If you have any complaints during your training, they should be made directly to your teacher trainer. If it is not suitable to direct your complaint to your teacher trainer, direct your complaint to another teacher trainer or a manager at the school. The Yoga Factory will ensure all complaints are handled seriously and are dealt with in the appropriate manner.

Deferment of Course Policy
If a teacher trainee cannot continue the course for unavoidable reasons, they may apply for deferment. Applications for a deferment must be made in writing and include supporting documentation (e.g., doctor certificate). Courses can be deferred for a maximum of 1 year from the start date of the registered course.
Suspension and Expulsion Policy
The Yoga Factory retains the right to suspend, expel or cancel the continuation of the teacher training program in respect of a teacher trainee where a teacher trainer fails to:
act in accordance with Yoga Australia’s Code of Professional Conduct, Statement of Ethics or Teacher Training Behaviour Policy as found on Yoga Australia’s website;
attend training without notification and reasonable explanation; or
complete all course requirements within the requested time frame,
The Yoga Factory will notify the teacher trainee where a suspension, expulsion or cancellation occurs. Where a suspension, expulsion or cancellation occurs, the teacher trainer may not recover a refund or seek a deferral of the course.
Prior-Notice Policy
Prior to the registration in a course provided by The Yoga Factory, the trainee is to notify The Yoga Factory of individual circumstances that would prevent them from completing the course in full. This would include, for example, any medical conditions, residency status or other commitments.
Refund Policy
It is expected that trainees who have registered for a course provided by The Yoga Factory acknowledge that they are making a commitment to completing the course in full to its conclusion. Registered trainees acknowledge that they have made a fully informed and considered determination to complete the course.
Teacher trainers are permitted to cancel their training at any time provided that a written notification is submitted to The Yoga Factory outlining their intention and reasons for cancelling their training. However, with no expectation of a refund.
In the case of unexpected circumstances, emergency or major life changes, refunds can be considered on an individual basis. The Yoga Factory incurs a cost by providing the teacher training course and cannot offer refunds where the reasons for cancelling are poor or inappropriate. This includes, for example, change of mind or minor dissatisfaction. The final decision about the possibility of the refund is left to The Yoga Factory and will be made taking into consideration individual facts and circumstances.
Where The Yoga Factory considers it appropriate to offer a refund, the refund will be based on a pro rata amount and a non-refundable administrative fee of $500. Will be deducted from this amount. Trainees whose cancellation and/or refund request is not processed to their satisfaction by the training provider may follow the training provider’s Complaints Policy.
Course Cancellation Policy
The training provider reserves the right to cancel any course or to postpone it to an alternative date. In this event, all registered teacher trainees affected by such postponement or cancellation will be offered the opportunity to transfer to the next available training course. If the teacher trainee is unable to attend the next available training course or any training course thereafter, they will receive a refund calculated on a case by case, pro-rata basis and may incur a non-refundable administration fee of 100$ from the course fee.
